These terms and conditions of sale (hereinafter simply “General Conditions”) govern the sale of products marketed by Col dei Franchi o.o.d. (hereinafter simply “Col dei Franchi”) through the website coldeifranchi.it (hereinafter the “Website”). All purchase agreements concluded through the above-mentioned website shall be governed by these General Conditions (in accordance with Italian law, in particular Legislative Decree no. 70/2003 implementing Directive 2000/31/EC on electronic commerce and Legislative Decree no. 206/2005 with specific reference to distance contracts).

Any changes or new conditions of sale will be promptly communicated to the Customer, will be effective from the moment of publication on the Website, and will apply only to sales concluded after such publication.

All prices published are inclusive of VAT.

ACCEPTANCE AND TERMS OF SALE

The contract between Col dei Franchi and the Customer shall be deemed concluded upon acceptance of the order by Col dei Franchi, which reserves the right, at its sole discretion, to accept the order. Acceptance shall be deemed tacit unless otherwise communicated to the Customer by any means.

By placing an order, using the available methods, the Customer declares that they have read all the information provided during the purchase procedure and fully accept these General Conditions.

Once the online purchase procedure has been completed, the Customer shall print, save an electronic copy, or otherwise retain these General Conditions.

PURCHASE METHODS

The Customer may purchase only the products available in the electronic catalog on the Website at the time the order is placed, as described in the relevant product information sheets.

The technical information provided on the Website faithfully reproduces that of the products in the catalog. Col dei Franchi reserves the right to modify technical product information without prior notice. Product images may not perfectly represent their characteristics and may differ in color, size, and/or included accessories.

Any contractual and/or non-contractual liability for damages to persons or property resulting from non-acceptance of an order, even partially, by Col dei Franchi is excluded.

All information supporting the purchase is to be considered general informational material.

Receipt of the order is confirmed by Col dei Franchi via email sent to the email address provided by the Customer. This confirmation message will include the date and time of receipt, a “Customer Code” identifying the order (to be used in all communications), and all data entered by the Customer. The Customer undertakes to verify the accuracy of such data and promptly communicate any corrections.

In case of non-acceptance of the order, Col dei Franchi will promptly inform the Customer via email.

All prices shown on the Website are public prices and include VAT. Col dei Franchi reserves the right to change prices at any time without notice. In case of clearly incorrect or unreasonably low prices, the order will be canceled, even if initially confirmed.

Shipping costs amount to €18.30.

Due to simultaneous access by multiple users and the possibility of multiple orders being placed at the same time, product availability may change rapidly; therefore, Col dei Franchi does not guarantee actual availability, even if the product is marked as “available.” If unavailable, the Customer will be promptly notified via email.

For certain promotional products, Col dei Franchi reserves the right to accept orders by reducing quantities, subject to Customer approval; otherwise, the order will be canceled.

PAYMENT METHODS

The Customer may purchase products using the payment methods indicated during the purchase procedure. Any additional costs related to specific payment methods will be clearly indicated during checkout.

DELIVERY METHODS

Col dei Franchi delivers products via specialized couriers. Products will be handed over to the courier within 5 working days from receipt of the order.

Shipping costs are generally borne by the Customer and are clearly indicated at the time of order.

Upon delivery, the Customer must check the integrity of the goods and note any issues on the delivery receipt.

The Customer has 10 working days from receipt to verify the integrity of the goods and report any damage to info@coldeifranchi.it. Col dei Franchi will issue a refund within 10 working days from notification.

RIGHT OF WITHDRAWAL

If the Customer is a consumer (a natural person purchasing goods for purposes unrelated to their professional activity), they have the right to withdraw from the purchase contract for any reason, without penalty and without providing a reason, within 14 working days from receiving the goods.

To exercise this right, the Customer must send a written notice to Col dei Franchi by registered letter with acknowledgment of receipt. The notice may also be sent via telegram, email, or fax, provided it is confirmed by registered letter within 48 hours.

The notice must include bank details for the refund and the “Customer Code.” Col dei Franchi will send a return authorization form via email, which must be printed and attached to the package.

The product must be returned within 14 working days, at the Customer’s expense.

The right of withdrawal applies only to the entire product, not parts of it.

The product must be returned intact, in its original packaging, complete in all parts.

Shipping risks remain with the Customer until delivery is confirmed. Col dei Franchi is not responsible for damage, theft, or loss of uninsured returns.

Upon valid withdrawal, Col dei Franchi will refund all amounts paid, including delivery costs (except additional costs for non-standard delivery), within 14 days of receiving the returned goods.

If the product has diminished in value due to improper use, the Customer is responsible for the loss in value.

If the withdrawal right lapses, the product will be returned to the Customer at their expense.

WARRANTIES

All products are covered by the legal guarantee of conformity under Legislative Decree no. 206/2005. To claim warranty service, the Customer must retain the invoice or delivery note.

In case of defects, the Customer has the right to repair or replacement free of charge, unless impossible or excessively burdensome. Otherwise, they may request a price reduction or contract termination.

The legal guarantee lasts 2 years and must be claimed within 2 months of discovering the defect.

In case of dispute, Col dei Franchi will:

  • take charge of the defective product for verification

  • repair or replace it within a reasonable time and without cost

PRIVACY

Personal data collected during ordering is used solely to fulfill contractual obligations and will not be shared with third parties. Col dei Franchi complies with Italian data protection law (Legislative Decree no. 196/2003).

The Customer may withdraw consent and access their data at any time.

Marketing communications are sent only with explicit consent.

PROTECTION OF MINORS

Col dei Franchi does not sell wine or alcohol to persons under 18, in accordance with Law no. 189 of November 8, 2012. Couriers may request ID upon delivery.

JURISDICTION AND APPLICABLE LAW

The contract is concluded in Italy and governed by Italian law.

If the Customer is a consumer, jurisdiction lies with the court of their place of residence. In all other cases, jurisdiction lies exclusively with the Court of Treviso.
